Hello, my name is Dan Gallic, and I have spent my entire career in the high-tech industry. I initiated this effort because, like many others at the forefront of technological advancement, I recognize that artificial intelligence (AI), if not properly regulated, poses a significant threat to humanity. While self-regulation within the industry is often preferable, it is imperative that the creators and innovators of AI, along with the tools they develop, are not solely relied upon to prevent both intentional and unintentional misuse of AI. Furthermore, the United States is notably lagging in the protection of individual rights related to digital personhood and privacy. This proposed U.S. constitutional amendment seeks to address both of these critical issues.
A US constitutional amendment is crucial to safeguard humanity from the potentially unchecked power of artificial intelligence (AI). As AI systems become increasingly sophisticated, they wield enormous influence over critical aspects of society, from privacy and security to decision-making in finance, healthcare, and beyond. Without clear constitutional protections, there is a risk that AI could be misused to infringe upon individual rights, exacerbate inequalities, and even undermine democratic processes. A constitutional amendment would ensure that the development and deployment of AI are guided by principles that prioritize human dignity, autonomy, and the protection of personal data, thereby preventing the erosion of fundamental freedoms in the face of rapid technological advancement. Additionally, United States citizens should have the right to digital privacy, which includes the "Right to be forgotten", digital ownership of personal history and a right to be compensated for the use of our private data.

These are the highlights of our Proposed Amendment
- Physical Harm: AI must be limited and controlled when it comes to interacting with humans.
- Manipulation: Humanity must be protected from the possibility of rougue AI which seeks harm through manipulation
- Digital Privacy: US Citizens have a right to total control of their data. And the right NOT to be tracked, reported on and analyzed.
- Protection of Data: Companies who seek to use data must have explicit approval form the person before any tracking can be started.

Proposed 28th Amendment to the United States Constitution: The Artificial Intelligence and Digital Privacy Protection Amendment
Section 1. For the purposes of this amendment, artificial intelligence (AI) is defined as any system or technology that, through automated processes, is capable of performing tasks that typically require human intelligence. This includes, but is not limited to, systems involved in decision-making, learning, problem-solving, perception, language understanding, and robotics.
Section 2. The right to be free from physical harm or endangerment by artificial intelligence (AI) systems shall be guaranteed to all individuals. No AI system, whether autonomous or human-directed, shall be designed, deployed, or allowed to operate in a manner that poses a risk of physical injury or death to humans. The development and use of AI in critical infrastructure, defense, healthcare, and other sensitive areas must be subject to rigorous safety standards to prevent harm to individuals and society. Any person or entity found to have willfully violated this section, resulting in physical harm or death, shall be subject to life imprisonment without the possibility of parole, and the forfeiture of all assets.
Section 3. Every U.S. citizen has the right to control their personal data, including the right to be forgotten. The "right to be forgotten" allows U.S. citizens to request the deletion of their personal data from any government or commercial entity, ensuring it is permanently removed from all systems, barring legitimate legal exemptions.
Section 4. AI systems shall not be used to manipulate or deceive individuals for political, commercial, or social purposes. Any use of AI to influence public opinion, elections, consumer behavior, or personal beliefs must be transparent, and individuals must be explicitly informed of the AI's role. The deliberate use of AI for manipulation, deception, or coercion shall be prohibited.
Section 5. Congress shall have the power to enforce this amendment through appropriate legislation, including the establishment of an independent agency tasked with monitoring AI technologies and enforcing digital privacy rights.
Section 6. This amendment shall take effect two years after the date of its ratification, allowing time for the necessary legal and institutional frameworks to be established.
